5. RBI revises rules for investment in Alternative Investment Funds
The Reserve Bank of India (RBI) has proposed new draft guidelines to ease investment norms for regulated entities (REs)—including banks and non-banking financial companies (NBFCs)—in Alternative Investment Funds (AIFs).
- This move aims to balance financial discipline with capital formation needs, following earlier restrictions imposed to curb risks like loan evergreening.
- Investment Caps: A single RE’s investment in any AIF scheme is proposed to be capped at 10% of the scheme’s corpus, while the collective investment by all REs in a scheme would be limited to 15%.
- Unrestricted Investments: Investments up to 5% of an AIF’s corpus by an RE would be allowed without any restrictions.
- Provisioning Requirements: If an RE’s investment exceeds 5% and the AIF has downstream debt exposure to a borrower linked to the RE (excluding equity shares and certain convertible instruments), the RE must make a 100% provision for its proportionate exposure.
Note:
- In December 2023, the RBI had barred REs from investing in AIFs that had investments in existing and recent borrowers, aiming to prevent practices like loan evergreening.
About AIF:
- Alternative Investment Funds (AIFs) are privately pooled investment vehicles that collect funds from investors—Indian or foreign—for investing in accordance with a defined investment policy for the benefit of their investors.
- They are regulated by SEBI under the SEBI (Alternative Investment Funds) Regulations, 2012.
